G.A. 5 Derby · Dual Arrests, Protective Orders, FVEP, and What Comes Next

Anger Management for Protective Order and Restraining Order Cases at G.A. 5 Derby — Live, Private, Court-Ready

Connecticut arrests first and sorts it out later. Under the mandatory-arrest statute an officer who finds probable cause of a family violence crime must make an arrest, whether or not the person who called wants one — and in 2023 the state still made dual arrests in more than 1,100 incidents. If you were arrested in Derby, or served with a restraining order, this page explains what happens next at G.A. 5 and the Ansonia–Milford J.D., and how a documented anger management program is used to mitigate the allegations.

G.A. 5 Derby — Restraining Orders, Protective Orders, and Anger Management

Bottom line for Derby: family violence cases at G.A. 5 and restraining orders at the Ansonia–Milford J.D. are about risk, and risk is argued with evidence. Enrolling in a documented anger management program before your hearing — not after the judge orders one — is how you put evidence on your side of the table. NJAMG: private one-on-one sessions seven days a week, lessons customized to the charge and the order, enrollment letter the same day, Certificate of Completion and Completion Letter on the day you finish, accepted or refunded. Derby and the G.A. 5 Family Violence Docket

G.A. 5 on Elizabeth Street in Derby is the criminal court for the lower Naugatuck Valley — Derby, Ansonia, Shelton, Seymour, and Oxford — a set of towns that together produced more than 420 family violence incidents in 2023, led by Ansonia’s 205. Civil restraining orders for Valley households are heard at the Ansonia–Milford Judicial District courthouse on West River Street in Milford.

Valley cases are close-quarters cases: multi-family houses in Ansonia and Derby where an argument carries through the wall, Shelton subdivisions where a co-parenting exchange went wrong, Seymour and Oxford households where a teenager and a parent came to blows. Connecticut’s family violence statute reaches all of them — spouses, former partners, parents and adult children, people who live together, people with a child in common, and people in a dating relationship — and the mandatory-arrest law means someone leaves in handcuffs.

Because G.A. 5 is a smaller court without a specialized domestic violence docket, cases resolve on a shorter timeline with fewer appearances. That makes early enrollment even more valuable: the enrollment letter at arraignment or the first pretrial, and the certificate before the prosecutor decides between FVEP, a nolle with conditions, and a plea.

Two Orders, Two Courtrooms: Restraining Order vs. Protective Order in Derby

A restraining order comes from the civil side of the courthouse; a protective order comes from the criminal side. In Derby they can be issued in the same week for the same household, and each is enforced by a felony charge. Here is how they differ.

Restraining Order

Civil · Relief from Abuse · Ansonia–Milford J.D.

  • Who can apply: a family or household member under § 46b-38a, including current or recent dating partners.
  • What must be shown: domestic violence under § 46b-1 — physical harm, threatened violence, verbal abuse with present danger, or coercive control.
  • Timeline: ex parte order same day if warranted; hearing within 14 days; order up to one year, extendable.
  • Consequences: no contact, exclusion from the home, firearms surrender, registry entry, and a felony (§ 53a-223b) for any violation.
  • What helps a respondent: an attorney, a calm and documented account, and proof of steps already taken.
Protective Order

Criminal · § 46b-38c · G.A. 5

  • Who issues it: the arraigning judge, the next business day after a family violence arrest.
  • Levels: full no-contact, residential stay-away, partial — with electronic monitoring available in some cases.
  • Duration: the life of the case; a standing order can follow a conviction under § 53a-40e.
  • Consequences: exclusion from the home, no contact through any channel, and a class D or C felony (§ 53a-223) for a violation.
  • What helps a defendant: compliance, Family Services check-ins that show progress, and a program the court can verify.

Nothing on this page is legal advice. Whether to contest a § 46b-15 order, apply for FVEP or AR, or accept a nolle with conditions is a decision for you and your attorney. What we do is make sure that when your attorney wants to point to a program, there is one to point to — started early, documented properly, and accepted by G.A. 5.

What Happens After a Family Violence Arrest in Derby

  1. The call and the arrestAn officer in Derby who finds probable cause of a family violence crime must arrest under § 46b-38b — the protected person cannot stop it. Since 2019 officers are supposed to identify the dominant aggressor, but dual arrests still happened in 1,154 incidents statewide in 2023.
  2. Next court business day: Family Services interviewBefore you see the judge at G.A. 5, a Family Services counselor interviews you, reviews the police report, and contacts the other party. The recommendation from that interview shapes the protective order.
  3. Arraignment and protective orderThe judge enters a full, residential, or partial protective order under § 46b-38c, sets conditions of release, and schedules the next date. Family violence dockets bring defendants back often.
  4. The mitigation windowBetween arraignment and resolution — weeks to months — the prosecutor, Family Services, and the judge form a view of you. This is when an enrollment letter, then progress documentation, then a Certificate of Completion, are handed up.
  5. ResolutionFamily Violence Education Program (dismissal on completion), Accelerated Rehabilitation, a nolle with conditions, a plea to a reduced charge, or trial. Anger management is frequently a written condition of the first three — and completed anger management is frequently the reason they are offered.

The Charges Behind a Derby Family Violence Case

Connecticut does not have a crime called “domestic violence.” It has ordinary criminal statutes plus a designation — family violence under § 46b-38a — that attaches when the accused and the complainant are family or household members: spouses and former spouses, parents and children, relatives by blood or marriage, people who live or have lived together, people with a child in common, and people in or recently in a dating relationship. The designation is what sends a Derby case to the family violence track at G.A. 5, triggers the Family Services interview, and produces the protective order. The underlying charges are usually these:

Assault in the Third Degree§ 53a-61 · Class A misdemeanor · intentionally causing injury, or recklessly causing serious injury
Disorderly Conduct§ 53a-182 · Class C misdemeanor · fighting, threatening, or tumultuous behavior; the most common family violence charge
Breach of Peace, Second Degree§ 53a-181 · Class B misdemeanor · fighting, threats, or abusive language in a public place
Threatening, Second Degree§ 53a-62 · Class A misdemeanor · a threat of physical harm that puts another in fear — texts count
Harassment, Second Degree§ 53a-183 · Class C misdemeanor · calls, texts, or messages made with intent to harass, annoy, or alarm
Stalking, Second Degree§ 53a-181d · Class A misdemeanor · a course of conduct that would cause a reasonable person to fear for their safety
Strangulation or Suffocation, Third Degree§ 53a-64cc · Class A misdemeanor · restricting breathing or blood flow — second degree (§ 53a-64bb) is a class D felony
Criminal Violation of a Protective or Restraining Order§ 53a-223 / § 53a-223b · Class D felony (class C with assault, threats, or restraint) · the charge that turns a misdemeanor case into a felony case

None of these is a felony on its own except the strangulation and violation-of-order counts. What turns a Derby misdemeanor into a felony is contact after the protective order — the single most avoidable mistake on the docket.

Mitigating the Allegations at G.A. 5 and the Ansonia–Milford J.D.: What Actually Moves the Needle

There is a version of the Derby case where you wait: for the judge to order something, for Family Services to recommend something, for the prosecutor to offer something. And there is a version where you move first. Attorneys who practice at G.A. 5 every week overwhelmingly prefer the second, because Connecticut’s family violence process gives the defendant several chances to be evaluated — the Family Services interview, each pretrial, the FVEP or AR hearing, the disposition — and a defendant with an enrollment letter at the first evaluation and a completion certificate by the last is scored differently at every one.

That record starts with a program. Not a website — Connecticut judges and Family Services counselors know the difference between a self-paced video and a live, instructor-led program, and several G.A. courts reject the former outright. It starts the day you enroll, with a letter your attorney can hand up. It continues with progress documentation at each appearance. It finishes with a Certificate of Completion that a clerk can verify with one call. Attorneys use that record to argue for a partial protective order, a modification, FVEP eligibility, an AR grant, a nolle with conditions, or favorable terms on a § 46b-15 order — and, in the family court next door, for parenting time.

One Instructor, Live, Seven Days a Week — Customized to the Charge and the Order

Every NJAMG program pairs two things: written lessons built on REBT and CBT methods, customized to the charge, the relationship, and the order in your Derby case; and live, private, one-on-one video sessions with the same instructor, available seven days a week, including early mornings, evenings, and weekends. There is no group. There is no cohort start date. There is no video library to click through. A session can be scheduled around a protective order’s curfew, a Metro-North commute, a hospital shift, or a Family Services appointment.

Because the instructor is the same person from intake to certificate, the documentation the Ansonia–Milford J.D. or Family Services receives is written by someone who actually worked with you and can describe your participation specifically. That is the difference between a certificate that gets a nod and one that gets a question.

Where NJAMG fits in a Connecticut case. The court controls FVEP, EXPLORE, and EVOLVE; NJAMG is none of them. What we provide is the private, verifiable anger management that a Derby defendant completes on their own initiative — before an FVEP hearing, during a protective order, or as the anger management condition written into an AR grant, a nolle, a plea, or a family court order at the Ansonia–Milford J.D..

  4. Private live sessions on your schedule, seven days a week, with lessons customized to the charge and the order.
  5. Completion documents the day you finish — Certificate of Completion and Completion Letter, verifiable by phone at (201) 205-3201.

Enrollment Letter Today. Certificate the Day You Finish. Accepted or Refunded.

Three checkpoints. The enrollment letter, ready the day you enroll, proves at the Family Services interview or the first pretrial at G.A. 5 that the program is underway. Progress documentation, produced on request, lets a prosecutor or a § 46b-15 judge see mid-case that you are on track. The Certificate of Completion and Completion Letter, delivered the day you finish, close the condition — or make the argument — with specifics a clerk can verify by phone.

No court in Connecticut or anywhere else has rejected NJAMG documentation since 2012. Our Court Acceptance Guarantee refunds your fee in full if G.A. 5 or the Ansonia–Milford J.D. is the first.

Search “anger management Connecticut” and you will find a dozen out-of-state operations promising “court approved in all 50 states” for a few dollars an hour. There is no such thing — no state has a universal approval system, and Connecticut leaves general anger management to the discretion of each judge and Family Services office, several of which reject self-paced programs outright. NJAMG is different in kind. It was founded in 2012 by Santo V. Artusa Jr., J.D., C.A.M.T., a retired New Jersey lawyer and former public defender, and every session is live, private, and taught by him.

That background is why the enrollment letters and certificates read the way they do, and why the program now serves clients in every state. Started in New Jersey. Serving America.

What if the court has already ordered a specific number of sessions?

Text us a photo of the order. Whether it reads eight sessions, twelve hours, or simply “anger management — proof of completion,” we build the program to match it and document it so no clerk at G.A. 5 has to guess whether the condition was met.

Is NJAMG the Family Violence Education Program?

No. FVEP — along with EXPLORE and EVOLVE — is a Judicial Branch program delivered by contracted providers, and only the court can send you to it. NJAMG is a private, psychoeducational anger management program used alongside the court’s process: to strengthen an FVEP or Accelerated Rehabilitation application, to support a protective order modification, to satisfy an anger management condition in a nolle, plea, or family court order, or to show a § 46b-15 judge what you have done since the incident.

Can proactive anger management get my protective order modified?

It is one of the most common grounds attorneys cite in a motion to modify a § 46b-38c protective order at G.A. 5. Modification requires a motion, a hearing, usually Family Services’ input, and a demonstrated change in circumstances. Documented participation in a live program is the change attorneys point to. The order stays in full force until the judge changes it.

What charges count as family violence in Connecticut?

Any crime between family or household members — spouses, exes, parents and children, relatives, people who live or lived together, people with a child in common, and current or recent dating partners — that causes or threatens physical harm. In Derby cases the usual charges are disorderly conduct, breach of peace, assault in the third degree, threatening, harassment, stalking, strangulation, and violation of a protective or restraining order.

Is this live, or is it a video I watch?

Live. Every session is a private video meeting with the same instructor, scheduled by you on any day of the week. Between sessions you complete written lessons customized to your case. There is no group and no self-paced course — which is exactly why G.A. 5 and Family Services accept the documentation and why several Connecticut courts reject self-paced programs.

What documents will my attorney get, and when?

A same-day enrollment letter the day you sign up; progress documentation on request at any point; and, the day you finish, a signed Certificate of Completion plus a separate Completion Letter describing sessions, hours, dates, curriculum, and participation. Every document lists (201) 205-3201 so G.A. 5 or the Ansonia–Milford J.D. can verify by phone.
